Fraud, Crime and regulatory work



Emily’s busy practice includes prosecuting and defending cases of serious violence, drug supply, sex offences and fraud and dishonesty offences.  Defence experience includes successfully arguing autrefois convict before a High Court judge as well as Newton hearings and the issue of fitness to plead.She is currently instructed to represent a mother alleged to have caused brain damage to her 3 month old baby. In addition Emily has provided advice for the defence in confiscation hearings where issues arise involving matrimonial property.



Emily has an established fraud and regulatory practice, having been instructed by a range of prosecuting authorities including the Serious Fraud Office, Fraud Prosecution Service, Revenue & Customs, Department of Work & Pensions and the Food Standards Agency.  Emily is regularly instructed to prosecute for the Attorney General as a member of the C Panel List of advocates.



General civil and personal injury



Emily represents both Claimants and Defendants in fast-track and multi-track cases in all areas of Personal Injury including employers’ liability, public liability, road traffic and criminal injuries compensation authority cases.  She is regularly instructed on behalf of trade unions and is content to work under conditional fee agreements where appropriate.  She has also attended inquest hearings in the Coroner’s Court, particularly in asbestosis and road traffic accident cases.



She also undertakes general civil work, having appeared regularly in both the County Court and High Court and argued successfully in the Court of Appeal.



Family



Emily is instructed by local authorities in relation to care proceedings, particularly care orders, supervision orders and emergency protection orders in the County Court, PRFD and High Court.  She has also represented parents in both care cases and private cases involving residence and contact disputes, and contested adoption cases.  She has dealt with clients who have difficulties with legal proceedings as a result of mental impairment.  She has been instructed in ancillary relief proceedings, including a successful argument that the other party had covertly and intentionally reduced the assets available for distribution by the court.  She is experienced in dealing with sensitive cases, and acted as amicus curiae to the court, instructed by the Treasury Solicitor, in order to cross-examine a child alleging sexual abuse against an unrepresented family member.



Police Law



Emily is developing her practice representing the police in SOPOs, ASBOs, closure orders including the notorious Lucky 7 Snooker Club E9, violent offender orders and other civil actions, and successfully argued an appeal by way of case stated in the High Court. She is regularly instructed in disclosure applications where there are concurrent family and criminal proceedings.

RCPO v Charalambous (2010) Successful RCPO prosecution worth £5 million by chartered accountant. Junior to Philip Henry.



R v Moussa (2010) Successful prosecution of conspiracy to defraud worth £50,000 by Harrods Gucci employee.



RCPO v Grundy & others (2007-2010) Successful prosecution of a £4 million cannabis importation conspiracy. Led by Rosina Cottage.



FPS v Lascelles (2010) Successful prosecution of employee for travel industry fraud worth £160,000. SOCPO granted.



RCPO v M (2010) Successful prosecution of a barrister for VAT offences.



DWP v Ireogbu (2010) Successful prosecution of large scale complex Sure Start fraud conducted by trusted employee with access to personal data.



FPS v Adama-Agbo & others (2009) Successful benefit and mortgage fraud prosecution.



MHRA v Patel & Kerrs Chemist (2009) Successful prosecution of a pharmacist for online international sales offences.



D4C Plc (2007-2008) Successfully defended company directors charged with auditing offences.



SFO v Bright and others (Independent Insurance Group Ltd) (2004 - 2008) Second Junior to Andrew Baillie QC in successful SFO prosecution.  Bright sentenced to 7 years, Condon to 3 years, Lomas to 4 years.



Mehta (2008) Instructed to advise defence in confiscation involving matrimonial property issues.



R v Joshi (2008) Successfully prosecuted the £million William Hill employee betting fraud.



R v Antoine (2005) Successfully prosecuted a £250,000 identity fraud at the Old Bailey.



General Crime



RCPO v Baranauskas (2010) Ground breaking prosecution of CS gas gun offence, involving expert evidence on firearm history and science.



R v Brown (2010) Successfully defended s.18 where defence was accident/self-defence.



R v Hirons (2010) Successful prosecution of aggravated burglary involving expert evidence on mobile telephones and discrediting alibi witnesses.



R v Elmi (2010) Successful prosecution of dangerous driving offence at Old Bailey where driver ploughed into pedestrians at 37mph.



R v Day (2010) Successful in Court of Appeal: sentence reduced from 6 to 3 years.



R v Gravenell (2010) Successful defence of rabbit hunter with alleged offensive weapon.



R v Manhertz (2009) Successful prosecution of drug importation from Caribbean.



R v Tuffin (2009) Prosecution of wounding case at the Old Bailey - jury hung.



R v Birch (2009) Successful defence of grandfather accused of repeated sexual assaults on granddaughter.



R v Dennis: Successfully prosecuted a child abuse case at the Old Bailey.



HMRC v King and Hibbart (2007) Prosecuted high value cocaine and cannabis importation – King sentenced to 8 years imprisonment.



R v Aboagye & others (2006) Junior in aggravated burglary trial. Led by Philip Henry.



R v Haynes (2005-2006) Successfully argued autrefois convict before Mr Justice Butterfield in high value amphetamine supply case.



R v O'Day (2006) Successfully defended man accused of setting his Staffordshire Bull terrier on his ex-partner.



Civil



UKBA v A (2010) Successful contested cash forfeiture.



Ford (2010) Successful settlement of clinical negligence case involving cancer sufferer.



Vernon v Butcher (2006-2007) Successful appeal where Court of Appeal issued guidance on law and experts in boundary disputes.



DPP v Saghir (2005) Instructed by the DPP in the High Court in a vote-rigging scandal.

M (2010) Representing Congolese Father in contested adoption final hearing in case of child with developmental delay.



C (2010) Representing LA in contested adoption final hearing in case of neglect of three children where mother was sectioned.



H (2009) Instructed by Tsol for Cafcass on discolsure hearing.



Nottingham County Council v R and H (2008) Instructed by Tsol to cross-examine a child alleging sexual abuse.



P (2007) Represented Mother with learning difficulties in sex abuse case.



Nhiliziyo v Met Police (2008) Successfully defended appeal by way of case stated in the High Court regarding a SOPO.
